NO PURCHASE NECESSARY TO ENTER OR WIN
1. How To Enter:
This sweepstakes begins on March 3, 2008, and ends at 11:59 p.m. PT on
May 31, 2008. Click the "Enter to Win" link located a
http://www.kswiss.com/contests/flushingny and complete the entry form
to enter. Upon completion of the form, you will be automatically
entered into the sweepstakes drawing. You may also enter by sending
postcard with your name, street and email addresses, phone number and
date of birth to Tennis Tourney Sweepstakes, 31248 Oak Crest Drive,
Westlake Village, CA 91361. Limit one entry per person and per e-mail
address. Sponsor K·Swiss is not responsible for late, lost,
misdirected, incomplete or otherwise ineligible entries regardless of
reason, including but not limited to computer or electronic
malfunction or other error. All entries become property of Sponsor and
will not be returned.
2. Eligibility:
Open to legal residents of the 50 United States, including the
District of Columbia, must be 13 years of age or older. Void where
prohibited or restricted by law. Employees (including immediate family
members and/or those living in the same household of each) of Sponsor
and its affiliates and subsidiaries, advertising and promotion
agencies and prize suppliers are not eligible. This sweepstakes is
subject to all applicable federal, state and local laws. The laws of
the United States govern this promotion.
3. Prize:
On or about June 5, 2008, Sponsor will conduct a random drawing from
among all eligible entries received. Winners will be notified on or
about June 10, 2008. There will be twenty-five (25) second-place
winners, who will each receive one pair of K·Swiss Ultra-Natural
tennis shoes (prizes will be delivered in the form of a $100 virtual
gift certificate to kswiss.com). There will be one (1) Grand Prize
winner. The Grand Prize will consist of two passes to watch portions
of the 2008 U.S. Open tennis tournament in Flushing, New York, in
August, 2008. The prize includes economy airfare for two from major
airport closest to winner's residence to New York City, and ground
transport from the airport to the hotel, two nights hotel lodging for
two, and passes for two to U.S. Open events (airfare not included if
winner resides within 200 miles of New York City, but in that case
winner will receive $150 in travel cash). Exact events will be
specified by Sponsor at its sole discretion. Travel must originate in
the 50 United States or the District of Columbia. Some elements of
this prize package are subject to availability and may change at the
sponsor's discretion. The retail value of the Grand Prize depends of
the winner's departure city but is approximately $2000.00. The
approximate retail value of all other prizes is $100.00. Odds of
winning depend on the number of eligible entries received. Limit one
prize per person, household or email address. ALL TAXES ASSOCIATED
WITH THE RECEIPT OR USE OF ANY PRIZE ARE THE SOLE RESPONSIBILITY OF
THE WINNER. The potential winner forfeits the prize if not claimed
within seven calendar days of first attempted notification, whether
notification is by e-mail, regular mail or telephone, or, if after
reasonable attempts are made, notification is unsuccessful. In such
event, the prize will be awarded to an alternate winner. Prize is not
transferable, except at discretion of Sponsor. No substitution of
prize or components by winner (even if winner is unable to travel on
dates convenient to the U.S. Open event dates), but in the event of
unavailability of any prize element, Sponsor will substitute a prize
of equal or greater value. Travel must include consecutive days in the
last two weeks of August, 2008, exact dates to be determined by
Sponsor it its sole discretion. Sponsor will notify winner of
U.S. Open event dates when Sponsor notifies winner that winner has won
the Grand Prize. The prize is awarded WITHOUT WARRANTY OF ANY KIND
from Sponsor, express or implied, without limitation. Entrants agree
to be bound by the terms of these official rules and by the decisions
of Sponsor, which are final and binding on all matters. Sponsor is
not liable in case any act of nature, terrorism, labor unrest, civil
strife, weather conditions, or other circumstances beyond Sponsor's
reasonable control prevent use/enjoyment of any prize. If winner is
under 18 years of age, winner's traveling companion must be winner's
parent or person appointed by winner's parent to accompany the winner.
Sponsor will require proof of parenthood (e.g., birth certificate) or
parental consent and will determine in its sole discretion whether
proof is adequate. Failure to provide adequate proof within ten (10)
calendar days of request shall disqualify winner.
4. Conditions of Participation:
Acceptance of a prize constitutes permission for Sponsor to use
winner's name and likeness for advertising and promotional purposes
without additional compensation, unless prohibited by law. Entrants
further grant Sponsor the right to use and publish their name and
state of residence online, in print and any other media in connection
with this sweepstakes. By entering, participants release and hold
harmless Sponsor, its parent, subsidiaries, affiliates, directors,
officers, employees and agents from any and all liability or any
injuries, loss or damage of any kind arising from or in connection
with participation in this sweepstakes or acceptance or use of the
prize.
5. Limitation of Liability:
By entering the contest, entrant agrees that (a) any and all disputes,
claims, and causes of action arising out of or in connection with the
contest, or any prizes awarded, shall be resolved individually without
resort to any form of class action; (b) any claims, judgments and
awards shall be limited to actual out-of-pocket costs incurred,
including costs associated with entering the contest, but in no event
attorneys' fees; and (c) under no circumstances will any entrant be
permitted to obtain any award for, and entrant hereby waives all
rights to claim, punitive, incidental or consequential damages and any
and all rights to have damages multiplied or otherwise increased and
any other damages, other than damages for actual out-of- pocket
expenses, even if such damages would have been foreseeable.
6. Individual Entry Only:
Each entry must be submitted only by the entrant, and only at the
authorized web site or by mail. Entries submitted by any other
individual or any entity originating at any other Internet web site or
e-mail address, including but not limited to commercial sweepstakes
subscription notification or entering service sites, will be declared
invalid ineligible for this promotion.
7. Internet:
If, for any reason, the Internet portion of the program is not capable
of running as planned, whether due to infection by computer virus,
bugs, tampering, unauthorized intervention, fraud, technical failures,
or any other causes beyond the control of Sponsor which corrupt or
affect the administration, security, fairness, integrity, or proper
conduct of this promotion, Sponsor reserves the right at its sole
discretion, to disqualify any individual who tampers with the entry
process, and to cancel, terminate, modify or suspend the
promotion. Sponsor assumes no responsibility for any error, omission,
interruption, deletion, defect, delay in operation or transmission,
communication line failure, theft or destruction or unauthorized
access to, or alteration of, entries. Sponsor is not responsible for
any problems or technical malfunction of any telephone network or
lines, computer on-line systems, servers, or providers, computer
equipment, software, failure or any e-mail or entry to be received by
Sponsor on account of technical problems, human error or traffic
congestion on the Internet or at any web site or any combination
thereof, including any injury or damage to entrant's or any other
person's computer related to or resulting from participation or
downloading any materials in this promotion. CAUTION: ANY ATTEMPT BY A
PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE
OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS,
AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK
DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY
LAW. In the event of a dispute, entries will be declared made by the
authorized account holder of the e-mail address submitted at time of
entry. "Authorized account holder" is defined as the natural person
who is assigned to an e-mail address by an Internet access provider,
on-line service provider or other organization (e.g., business,
educational, institution, etc.) that is responsible for assigning
e-mail addresses for the domain associated with the submitted e-mail
address.
8. Winners List:
After the promotion has concluded, a list of winners may be obtained
by sending a self-addressed stamped envelope by July 15, 2008, to
Tennis Tourney Sweepstakes Winners List Request, 31248 Oak Crest
Drive, Westlake Village, CA 91361.
